Splish Now ApS acting only as an intermediary and not as a seller. It is the partner, and not Splish Now ApS, which delivers the goods. The collaboration partner is responsible for the fulfillment of the agreement and is the actual contracting party of the consumer. We therefore encourage the customer to always contact the dealer first. Splish Now ApS will always be helpful in acquiring the contact for the business partner. See possibly the item card and the order confirmation for information about the contracting party. 

Display of goods on the online store is not an offer that can be used to make offers. A binding agreement is only concluded when you receive an order confirmation.

The following sales and delivery conditions apply to all deliveries from splish.dk. The conditions apply in the event that no other written agreements have been entered into between the buyer and splish.dk.

Payment of the item

Splish.dk is open 24 hours a day, so you can almost always shop. However, it may happen that we close the shop due to maintenance. You can only make purchases when the store is open and available.

To act on splish.dk you must be 18 years of age and in possession of a valid payment card that we accept. If you are not yet 18 years old, you can still buy goods if you have obtained the consent of your guardian or otherwise have the legal right to enter into the purchase.

You select the items you want to buy and put them in the "shopping basket". You can correct the contents of the shopping basket right up to the time of ordering, and you can continuously check the contents and the price of the goods.

Any additional payments for e.g. shipping will only be calculated immediately before you are ready to pay.

When you are ready to order, you click on "go to checkout", where you enter your name, address, e-mail, telephone number, payment method and choose the delivery method.

You can change this content in the shopping basket until you confirm that your purchase can be accepted and completed. Your order is then forwarded to the store via splish.dk.

The money will only be deducted from this payment card when it has been dispatched from the store.

Every time you order an item through splish.dk, we will first and temporarily send order confirmation that we have received your order. When the store accepts your order, we send an order confirmation to you as a customer and an order to the store you buy the item from, which then packs your item and sends it off to you.

To optimize the buying experience on splish.dk it may happen that we send regular e-mail invitations to customers to review our services. For example via newsletters or Trustpilot etc.

Where do we ship your order from?

Splish.dk cooperates with partner stores throughout Europe. This means that the goods can be sent from different countries in the EU. Some of our partner stores are also outside the borders of the EU. If this is the case, then you do NOT have to pay anything extra in customs duties. These taxes are covered by us, which means that the price you see next to the product and in the shopping cart is exclusively the price you pay for.

NOTE: The only products that may incur customs duties are original works of art sent outside the EU. 


Pricing and Availability

We do our best to provide safe information, product descriptions and prices on our website. Please note that we receive this information from our splish.dk-partners and there may be situations where errors may occur.

If we discover a pricing error on a product you have ordered, we will make sure to respond to this and notify you as soon as possible on our behalf splish.dkpartner and give you the opportunity to either confirm your order at the correct price or cancel your order. If we cannot get in touch with you, your order will be cancelled. If you decide to cancel your order for which you have already paid, we will immediately refund the amount.

Gift Card

Gift cards and gift card codes are issued by Splish Now ApS. They are valid for 2 years from issue.

Shipping and Postage

Depending on the individual splish.dk partners, then they themselves set the shipping price before an order. The partners themselves decide the price, the logistics partners and whether they want to send to the delivery location in question. Any errors and risks are therefore the full responsibility of the partners.

By signing up for the newsletter, you consent to Splish Now ApS sending you marketing per e-mail, SMS and MMS regarding products that are marketed and sold directly by splish.dk, including art, lighting, frames, accessories, home products and services, furniture, offers, sales, competitions, events and other similar marketing initiatives. You also consent to receive service emails about interrupted order processes.

The inquiries may also contain information about the above products and services from Splish's partner stores. You can get information about partner stores on request. The list of partner stores will be continuously updated. You can always unsubscribe from our newsletter here or via your emails from us.

Complaints

NOTE: Since splish.dk is not a party to the agreement, all complaints must go through the retailer of the product. You can see who the contracting party is on your order confirmation. Alternatively, you can contact us and we will put you in touch with your contracting party. When returning the item, the condition must be the same as when you received the item. 

Your purchase is covered by the Sales Act, including the defect rules. This means that you can either get a defective item repaired, exchanged, your money back or a discount, depending on the specific situation. It is of course a requirement that the complaint is justified and that the defect has not arisen as a result of incorrect use of the product or other damage-causing behaviour.

A complaint case is basically a case between you and the retailer. You must contact us and advertise within a "reasonable time" after you have discovered the lack of the item.

Depending on the specific situation, you will receive further instructions. When returning the item, please also state in as much detail as possible what the problem is.

In the event of a justified complaint, we will refund reasonable shipping costs. Otherwise, you must cover all transport costs yourself, including our shipping costs for returning the item after examination, and we can also charge you an amount of up to DKK 150 for examining the item.

Remember that the item must always be sent in proper packaging and receive a receipt for dispatch. You are responsible for the package/goods yourself until we receive them. Therefore, save the postal receipt incl. information on shipping costs and any track and trace number. 

Should a dispute arise between the customer and the retailer, the responsibility falls back on Splish Now ApS, which can therefore overrule the dealer at any time.

Note! We do not receive packages sent by cash on delivery or similar. 

14 day right of withdrawal

When you shop online and at splish.dk, you normally have a 14-day right of withdrawal, during which you can inform us that you regret the purchase and then return the item to us. It is your contracting party that handles cancellation cases. 

The right of withdrawal runs from the day you received the item. If the deadline expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, the deadline is extended to the following weekday.

After receipt, you may only handle the goods in a way that allows you to determine the nature, properties and way in which they function.

In order to exercise the right of withdrawal, you must inform us of this by means of an unequivocal statement no later than 14 days after receiving the goods. You must always register your return at: kontakt@splish.dk if you wish to cancel your purchase. 

Extended right of return when purchasing Christmas presents

Orders purchased from 16/11-2020 until 24/12-2020 can be returned until 15/01-2021. You must always register your return at:

Return

If you regret the purchase, the goods must be returned to the store that sent the goods in the first place. The condition of the item must be the same as when the customer received the item. 

When returning, you should ensure that the goods are securely wrapped. You are responsible for the package/goods yourself until the store receives them. Therefore, always keep the receipt for dispatch and the track and trace number.

Return is at your own risk and Splish Now ApS therefore does not pay for return labels or the like. 

IMPORTANT:

We expect you to send the goods as soon as possible after you have given notice of cancellation, and you must send them back no later than 14 days after you have canceled. Note! We do not receive packages sent by cash on delivery.

You must enclose a copy of the order confirmation or other documentation for your purchase. 

The item's condition when you return it
You are only liable for any deterioration in the value of the goods which is due to handling other than what is necessary to determine the nature, characteristics and way of functioning of the goods. In other words, you can try the product in the same way as if you tried it in a physical store, but you have to for put it to actual use.

If the item is tried in addition to what is described above, we consider it used, which means that upon cancellation of the purchase, you will only receive part or none of the purchase amount, depending on the trade value of the item.

Refund

When we receive the item, we check it and you will be reimbursed the amount you paid to us at the time of purchase. If you regret your purchase, you will get the amount you paid us back. In the event of a decrease in value for which you are liable, this will be deducted from the purchase amount.

If you exercise your right of withdrawal, we will refund all payments received from you, including delivery costs (but not additional costs resulting from your own choice of a different form of delivery than the cheapest form of standard delivery that we offer), without undue delay and under all circumstances no later than 14 days from the date on which we have received your returned goods.

The amount is always transferred to the same means of payment with which you paid for the purchase. For example, if you have paid by card, the purchase amount will be refunded to the payment card you used for the purchase. Missing original packaging may constitute a reduction in value, so to be sure of receiving all the money back, it is recommended that the item is returned in original packaging.

Uncollected packages:

If we receive a package that has not been collected from e.g. GLS/DHL Express, etc., we reserve the right to charge you for costs for this.

Law and venue

Purchase of goods on www.splish.dk is subject to Danish law. Any dispute is settled by the ordinary Danish courts.
